
Yes, but only in a narrow, specific sense. A small number of stem cell products have gone through FDA review and are legally approved for defined uses, mainly blood-forming stem cell transplants for blood and immune disorders (U.S. Food and Drug Administration, 2021).
The vast majority of stem cell "therapies" marketed for orthopedic, neurological, cosmetic, or anti-aging purposes are not FDA-approved. They are legal only when administered within a registered clinical trial.
Outside of that, offering them for profit is against federal law (U.S. Food and Drug Administration, 2021; Turner, 2021).
What This Means
The word "legal" hides a lot of nuance here. Stem cells themselves aren't illegal — it's how they're processed and used that determines their legal status.
The Narrow FDA Exception
If a product is minimally manipulated and used for its normal biological function within the same procedure, it may fall under a narrow FDA exception.
Everything else — including most of the umbilical cord, amniotic, and "mesenchymal stem cell" injections advertised for joint pain, fatigue, or anti-aging — is regulated the same way a new drug would be.
It needs FDA approval or an active clinical trial to be offered lawfully (U.S. Food and Drug Administration, 2021).
The 2024 Court Ruling
In 2024, a federal appeals court reinforced this position, ruling that a clinic's stem cell product did not qualify for a narrow surgical exception and was subject to FDA drug regulation.
The U.S. Supreme Court declined to revisit that ruling in 2025, leaving FDA oversight intact (Aaron et al., 2026).
In plain terms: if a clinic tells you their product is "not regulated by the FDA" or "doesn't need approval because it's your own cells," that claim should raise concern, not confidence.
Candidacy
Because so few stem cell uses are actually FDA-approved, "candidacy" looks different depending on what's being discussed.
For FDA-approved hematopoietic (blood-forming) stem cell products, candidacy is determined by a hematologist or transplant specialist based on the clinical findings, prior care, and donor matching for conditions like leukemia, lymphoma, or certain inherited blood disorders (Mayo Clinic, n.d.).
For everything else — orthopedic, cosmetic, or general "regenerative" stem cell injections — the honest answer is that there is no established candidacy pathway outside of a registered clinical trial. The product hasn't been proven safe and effective for that use.
Patients considering these unapproved options should understand they are, by definition, participating in something investigational, whether or not the clinic frames it that way.
Clinical Evaluation
For approved uses, evaluation follows standard transplant medicine. It includes:
- Diagnostic labs
- Imaging
- Disease staging
- Donor-matching studies
- A multidisciplinary team review before a treatment plan is set (Mayo Clinic, n.d.)
For unapproved regenerative or orthopedic stem cell products, a responsible clinician's evaluation should include:
- A full medical history
- An honest conversation about what current evidence does and doesn't show
- A review of the product's regulatory status — is it FDA-approved? Is it part of a listed clinical trial?
- Documentation that the facility manufacturing the product is FDA-registered and complies with cell-processing safety standards (U.S. Food and Drug Administration, 2021)
If a provider skips this conversation, that's a warning sign.
Available Options
Patients researching "stem cell therapy" often aren't aware of the full menu of options, which include both regenerative and conventional paths.
FDA-approved hematopoietic stem cell products (for example, cord-blood-derived options used in transplant medicine) are available through licensed transplant centers for specific blood and immune conditions.
Enrollment in an FDA-registered clinical trial is the legal way to access most other investigational stem cell approaches, and trials are searchable through ClinicalTrials.gov.
Conventional, well-established options remain the evidence-backed first-line choices for most conditions patients associate with stem cell marketing. These include:
- Physical therapy
- Corticosteroid or hyaluronic acid injections
- Anti-inflammatory medication
- Surgery for orthopedic conditions
- Standard-of-care protocols for neurological and autoimmune disease
Finally, some clinics offer other orthobiologic procedures, like platelet-rich plasma (PRP), which have a different (though still evolving) regulatory picture than stem cell products and should not be confused with them.
Benefits, Limitations & Risks
Benefits
Where stem cell science is proven, the benefits are substantial. Hematopoietic stem cell transplants can be curative for certain blood cancers and immune disorders (Mayo Clinic, n.d.).
Risks and Limitations
Where it isn't yet proven — most of what's marketed directly to consumers — the picture is far less reassuring.
The FDA has documented serious adverse events from unapproved stem cell products, including bloodstream infections tied to contaminated cord-blood-derived injections, vision loss, tumors, and other complications (U.S. Food and Drug Administration, 2021).
A 2021 analysis identified more than 2,700 U.S. clinics across roughly 1,480 businesses marketing unlicensed, unproven stem cell interventions, often without the clinical evidence to back their claims (Turner, 2021).
Limitations are just as important to name plainly. Even where research is promising, "promising" is not the same as "proven." Most direct-to-consumer stem cell products have not been tested in the kind of controlled trials the FDA requires before approval.
What the Evidence Shows
Current evidence firmly establishes that hematopoietic stem cell transplantation is effective for specific blood and immune conditions, which is why those products carry FDA approval (U.S. Food and Drug Administration, 2021).
Evidence does not currently establish that direct-to-consumer stem cell injections reliably work for orthopedic pain, neurological disease, autoimmune conditions, or aging itself. These remain active areas of study.
The International Society for Stem Cell Research explicitly cautions patients that stem cell procedures offered outside of legitimate clinical trials generally lack the rigorous evidence needed to confirm safety or effectiveness (International Society for Stem Cell Research, 2024).
Peer-reviewed researchers have also raised concern that federal oversight, while legally upheld, remains difficult to enforce at the scale of the current direct-to-consumer market (Aaron et al., 2026).
Recovery / Next Steps
For patients evaluating an FDA-approved hematopoietic stem cell transplant, recovery is a monitored, multi-week to multi-month process managed by a transplant team, with close follow-up for infection risk and graft function (Mayo Clinic, n.d.).
For patients considering any other stem cell product, the most important "next step" is verification, not a procedure. Take these steps before proceeding:
- Ask the clinic directly whether the product is FDA-approved or being administered as part of a registered clinical trial
- Request the manufacturing facility's FDA registration status
- Get a second opinion from an independent physician who has no financial stake in the procedure (International Society for Stem Cell Research, 2024)
Orlando Considerations
Florida has one of the highest concentrations of direct-to-consumer stem cell clinics of any state (Turner, 2021). Orlando patients should be aware the state passed new legislation specifically to regulate this space.
As of July 1, 2025, Florida Statutes § 458.3245 permits Florida-licensed physicians to administer certain human-tissue-derived stem cell products for orthopedic, pain management, and wound care uses. This is allowed only when:
- The products are retrieved, manufactured, and stored at a facility that is FDA-registered and accredited by a recognized certifying body
- Post-thaw viability testing documentation exists for that specific product lot (Fla. Stat. § 458.3245, 2025)
This law narrows, but does not eliminate, the gap between marketing claims and lawful practice. Orlando patients should still confirm a clinic and its product source meet these specific state requirements before treatment, and should not assume that a Florida-based clinic is automatically compliant.

Is it illegal for a clinic to offer me stem cell therapy?
